Terms and Conditions of Use

1. Identification
The technological platform marketed under the Innhapp brand (hereinafter, the "Platform") is operated by Innviteme Solutions, SL, with registered address at C/ Gregorio Benítez 10, 1C, Madrid (28043), Spain, Tax ID (CIF) B22958961, and contact email address hello@innhapp.com (hereinafter, the "Provider").
Hotels, hostels, or other accommodation providers that facilitate access to the Platform for their guests (hereinafter, the "Hotel") are neither owners nor operators of the Platform, without prejudice to their possible role as organisers of Happenings under clause 7.
The end user (hereinafter, the "User") is the natural person who, while staying at the accommodation, voluntarily decides to register on the Platform.
2. Purpose of the Service
The Platform is an optional technological solution whose purpose is to:
- facilitate digital contact between guests staying at the same establishment, based on interests, language, or other preferences declared by the Users themselves; and
- allow the creation and management of plans called "Happenings", which other Users may join voluntarily if availability exists, whether created by Users or by the Hotel itself.
The Platform:
- does not guarantee compatibility, affinities, or results;
- does not verify identities beyond the technical verification of the stay;
- does not organise, supervise, or intervene in the execution of Happenings, regardless of who created them;
- does not organise meetings or intervene in relationships between Users.
The Provider acts exclusively as a technology provider, limiting itself, in the case of Happenings, to offering the channel for creation, publication, and registration.
3. Acceptance of the Terms
Access to, registration on, or use of the Platform implies the express, full, and unreserved acceptance of:
- these Terms and Conditions;
- the Privacy Policy;
- any additional rules published on the Platform.
If the User does not agree with these texts, they must refrain from using the Platform.
4. Eligibility and Registration
4.1 Requirements
To use the Platform, the User declares and warrants that:
- they are over 18 years of age;
- they have the legal capacity to accept these Terms;
- they are effectively staying at the Hotel;
- they provide truthful and up-to-date information.
4.2 Reservation Verification
To register, the User must select from a list the Hotel where they are staying and enter their reservation number.
The Provider validates that reservation number against the selected Hotel's property management system (PMS), checking exclusively: (i) that the reservation is valid; and (ii) the check-in and check-out dates associated with it.
The Provider does not check that the person registering is the holder of the reservation, nor does it verify their identity by any other means. The User is responsible for the accuracy of the data they enter and for the proper use of the reservation number.
5. Limited Duration of the Profile
The applicable check-out date is the one obtained through the reservation validation described in section 4.2.
- The profile and associated chats will be automatically deleted once that date is reached.
- The User may voluntarily delete their profile at any time prior to check-out.
- Once the departure date has passed, it will not be possible to recover the account or messages.
If the User who organised a Happening ends their stay before it takes place, the Happening will be automatically cancelled and the registered Users will be notified, without any liability for the Provider.
6. Service Operation
The Platform allows the User to:
- view profiles of other active guests of the same Hotel;
- send connection invitations;
- accept or ignore received invitations;
- initiate chats only after mutual acceptance.
Unaccepted invitations do not generate any negative notification to the sending User and remain pending.
7. Happenings
7.1 Nature and role of the Provider
Happenings are voluntary plans that any User, or the Hotel, may create within the Platform, and which other Users may freely join if availability exists.
The Provider acts exclusively as a technological channel for creation, publication, and registration. The Provider does not organise, supervise, accompany, verify the suitability or safety of the location or activity, and does not guarantee the holding, development, or outcome of any Happening, regardless of whether it was created by a User or by the Hotel.
Notwithstanding the above, the Provider may review the content published in Happenings (title and description) in order to detect inappropriate language, insults, offensive content, or the proposal of manifestly unlawful activities or activities unrelated to the expected use of the Platform, and may reject their publication or remove them at any time. Such content review is for moderation purposes only and does not imply supervision, organisation, or any guarantee regarding the actual execution of the described activity.
7.2 Creation, modification, and cancellation
The organiser of a Happening (User or Hotel) may define its title, description, date, time, capacity, and location, as well as modify or cancel the Happening at any time.
In the event of cancellation or relevant changes (date, time, place, or capacity, including a reduction in capacity due to having mistakenly offered more places than actually available), the affected Users will be notified, explaining the reason where applicable.
The Provider assumes no liability arising from the cancellation, modification, or non-holding of a Happening, nor for any costs or losses the User may have incurred outside the Platform in relation to that Happening.
7.3 Happenings created by the Hotel
When a Hotel creates a Happening, it acts as the actual organiser of that activity and is responsible for its suitability, safety, capacity, and compliance with applicable regulations, including, where applicable, obtaining the necessary permits, licences, and insurance, particularly when the activity involves relevant physical risk, professional supervision or equipment, or takes place outside the Hotel's premises.
The Provider limits its involvement to the technological management of publication and registration, without assuming any role as organiser, companion, or supervisor of the activity.
Expressly authorised Hotel staff have general access to the profiles of Users staying at the Hotel and to the public content of Happenings published on the Platform, regardless of who created them, without such access ever including messages between Users, on the terms described in the Privacy Policy.
7.4 Registration and visibility
Any User can see who the organiser of a Happening is and the list of registered Users, as well as check whether those Users are already their connections. If they are not, the User must send a connection invitation, which must be accepted by the other party, in order to start a conversation.
If any of the participants in a Happening corresponds to a User whom the User had previously blocked, this circumstance will be flagged in the list, for purely informational purposes, so they can decide whether to participate.
If, on the other hand, any participant corresponds to a User who had blocked the User, that participant will be shown normally in the list, without any special indication. Only if the User expressly views that participant's profile will a generic unavailability message be shown ("User not available"), without in any case confirming that they have been blocked.
The User may withdraw from a Happening they had registered for at any time, without need for justification.
7.5 Blocks, reports, and exclusion from Happenings
If the organiser of a Happening has blocked or reported another User, that User will not be able to view the Happening or register for it.
If the organiser blocks a User who had already registered, that User will be automatically excluded from the Happening, receiving a notification informing them that their removal is due to that block by the organiser. Since the identity of a Happening's organiser is always public to its registrants, this notification does not reveal any additional information about that identity.
The Provider may likewise remove any User from a Happening, or delete a Happening entirely, for security or moderation reasons, including breach of the content rules set out in clause 7.1, without this giving rise to any right to compensation.
7.6 Nature of Happenings and assumption of risk
Happenings are voluntary social activities between Users, or between Users and the Hotel, which may take place inside or outside the Hotel's premises and take any format (sporting, gastronomic, recreational, nightlife, or other).
The User expressly acknowledges and accepts that, regardless of location or format, the Provider does not organise, accompany, supervise, or guarantee any safety standard regarding Happenings, nor regarding who created them.
The User participates in Happenings voluntarily and at their sole responsibility, assuming the risks inherent to the specific activity in question (including, among others, those of physical activity, travel to the meeting point, or interaction with unknown third parties), as well as the personal decisions they make in that context, including, where applicable, the consumption of alcohol. Such risks and decisions are not determined by the nature or location of the Happening, nor are they attributable to its organiser or to the Provider.
7.7 Costs associated with a Happening
Participation in a Happening may involve costs outside the Platform (drinks, meals, transport, tickets, or others). The Provider does not intervene in the management, collection, or splitting of such costs, does not guarantee compliance with any financial arrangements Users may reach among themselves in relation to a Happening, and assumes no liability in this regard.
8. User Conduct
The User undertakes to use the Platform responsibly, respectfully, and in accordance with the law.
The following actions are expressly prohibited:
- harassing, intimidating, threatening, or bothering other Users;
- publishing offensive, sexually explicit, violent, discriminatory, or illegal content;
- impersonating others or creating fake profiles;
- requesting money, financial favours, or services, except for the splitting of costs directly associated with a Happening under clause 7.7;
- using the Platform for commercial, professional, or advertising purposes, including the creation of Happenings that constitute, de facto, disguised commercial promotions;
- creating or participating in Happenings for unlawful purposes.
Non-compliance may result in the immediate suspension or deletion of the profile or the relevant Happening, without prior notice.
9. User Content
The User is solely and exclusively responsible for the content they publish on the Platform, including the content of the Happenings they create.
The Provider:
- does not verify the accuracy of the content;
- does not guarantee its legality;
- may remove content, profiles, or Happenings that breach these Terms or in response to reports of inappropriate behaviour.
The User declares and warrants that the photographs they publish correspond to their own person, that they hold the necessary rights for their use, and that they do not infringe third-party rights.
Registration Data and Communications
The User acknowledges that registration on the Platform is carried out through third-party authentication services (Google or Apple), through which the Provider receives only the User's full name and validated email address.
Such email address, as well as push notifications, will be used exclusively for the technical management of the account and of Happenings, and for exceptional and necessary communications related to service operation, security, or compliance with legal obligations.
10. Blocking, Reporting, and Moderation
The User may at any time:
- cancel a connection;
- block another User;
- report inappropriate behaviour.
For security and conflict-prevention reasons:
- as a general rule, the blocked or reported User will not be explicitly informed of this circumstance, except in the specific case set out in clause 7.5 (exclusion from a Happening due to a block by its organiser, whose identity is already known to the User as the organiser of the Happening);
- the Provider may adopt the measures it deems appropriate.
The Platform does not actively supervise all interactions, but acts upon reports.
11. User Responsibility
The User expressly acknowledges and accepts that:
- they use the Platform at their sole responsibility;
- any interaction with other Users, including the creation of or participation in Happenings, is carried out at their own risk;
- they must act with caution and common sense, especially if they decide to hold in-person meetings or participate in activities outside the Hotel.
12. Exclusion and Limitation of Liability
12.1 Hotel Disclaimer
The User expressly acknowledges that, as a general rule, the Hotel:
- does not control, supervise, or moderate the Platform;
- does not verify profiles or identities;
- does not participate in communications or meetings between Users.
The Hotel is fully and absolutely exempt from any liability, whether direct or indirect, arising from the use of the Platform or from interactions between Users.
When the Hotel creates a Happening, it will assume the responsibility of an organiser regarding that specific activity, on the terms of clause 7.3, which does not affect the above exemption regarding the general operation of the Platform.
12.2 Provider Disclaimer
The Provider shall not be liable for:
- the conduct, identity, or intentions of Users;
- the content, holding, development, cancellation, or outcome of any Happening, regardless of who created it;
- physical, psychological, emotional, or economic damages;
- incidents, conflicts, or offences arising from in-person meetings or from participation in Happenings;
- data loss or technical failures.
The Platform is provided "as is" and "as available", without warranties of any kind.
13. Service Termination
The Provider may suspend or delete profiles or Happenings:
- for breach of these Terms;
- for security reasons;
- in the event of suspicious or unlawful activities.
14. Intellectual Property
All rights to the Platform, its technology, design, and content belong to the Provider.
Any reproduction, use, or exploitation without express authorisation is prohibited.
15. Amendments
The Provider may modify these Terms at any time.
Continued use of the Platform implies acceptance of the updated versions.
16. Applicable Law and Jurisdiction
These Terms are governed by Spanish law.
The parties submit to the courts of Madrid, expressly waiving any other jurisdiction.
